Tertiary sector decree: Have you declared your consumption on OPERAT?

The Tertiary Decree or Eco Energie Tertiary scheme, which came into force on October 1, 2019, is a piece of legislation making it mandatory to carry out actions to reduce end-use energy consumption in tertiary buildings.

Declarations on the OPERAT platform are compulsory for all commercial buildings or premises with a floor area of 1,000 m² or more.

If you are the owner or tenant of a building over 1000 m², you can contact us for assistance with this regulatory declaration.

Green Tech offers assistance on the Tertiary Eco Efficiency Scheme or Decree Eco Efficacité Tertiaire (DEET), also known as the “Tertiary Decree”.

The obligation concerns 3 types of building:

Buildings with a surface area equal to or greater than 1,000 m² used exclusively for tertiary purposes

All parts of a mixed-use building housing tertiary activities with a combined floor area equal to or greater than 1,000 m².
Groups of buildings located on the same plot of land or on the same site when these buildings house tertiary activities on a cumulative surface equal to or greater than 1000 m².

There are reporting obligations, but also targets to be met by 2030, 2040 and 2050.

→ Consumption threshold to be reached (in kWh/m²/year) which is determined for each activity category and readjusted.

📄Gathering and monitoring consumption data on OPERAT

OPERAT manages the collection and monitoring of energy consumption in the tertiary sector. This platform, managed by ADEME, is also used for modulation requests.

This platform is also a tool to help taxable persons implement their action plan.

The landlord and tenant must each create their own account and make their own Declarations (a third party may be responsible for this task):

→ Structure declaration

→ Reporting Functional Entities (EFA)

→Definition of Unique Building Identifiers (IUB)
→Declaration of sub-activities and surface areas
→Declaration of consumption
